Nu se poate contesta proba practică a examenului auto deoarece nu pot fi întrunite toate condițiile de desfășurare a examenului contestat. Practic, valorile de trafic, condițiile meteo-rutiere și comportamentul celor implicați nu pot fi reconstituite, astfel că examinatorul este suveran.
